AuscultifyTerms of Use
These Terms of Use ("Terms") govern your access to and use of the Auscultify iOS application and this website (together, the "Service"). By downloading or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Educational use only — important medical disclaimer
Auscultify is an educational and training tool. It is not a medical device and is not intended for diagnosis, treatment, or clinical decision-making. The recordings, descriptions, and quiz content are provided for learning purposes only and must not be used to diagnose or treat any patient. Always rely on qualified clinical judgment, supervised training, and validated instruments in real patient care. Auscultify makes no warranty that the content is complete, current, or suitable for any clinical purpose.
2. Eligibility
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. By using it, you represent that you meet this requirement.
3. Subscriptions, free trial, and payment
- Auscultify is free to download and offers a Pro subscription with additional features.
- Pro plans may include a 7-day free trial. If you do not cancel before the trial ends, the subscription converts to a paid term and your Apple ID is charged.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel your subscription in your Apple ID settings.
- All payments are processed by Apple under the App Store terms; refunds are handled by Apple according to its policies.
4. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own educational purposes. You may not copy, redistribute, resell, reverse-engineer, or extract the recordings or content, or use them to build a competing product.
5. Acceptable use
You agree not to misuse the Service, interfere with its operation, attempt to gain unauthorized access, or use it in violation of any applicable law.
6. Intellectual property
The Service, including its recordings, text, design, and software, is owned by Auscultify and its licensors and is protected by intellectual property laws. All rights not expressly granted are reserved.
7. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
8. Limitation of liability
To the maximum extent permitted by law, Auscultify shall not be liable for any indirect, incidental, consequential, or special damages, or for any clinical outcome, arising from your use of or inability to use the Service.
9. Changes to the Service and Terms
We may modify or discontinue features, and we may update these Terms. Continued use after changes take effect constitutes acceptance of the revised Terms.
10. Governing law
These Terms are governed by the laws applicable at Auscultify's principal place of business, without regard to conflict-of-laws rules.
